Question : I purchased a mobile set bearing model lava B5 from market bearing bill no.443 dated 10/02/2011, M/S Saklani Telecom, Main Bazar Dharmpur, Distt. Mandi HP. After one month, it got mike problem and saw to the dealer& dealer said it has been sent to the service centre and came back after 16 days and see the problem was not solve and the condition of mobile set was very bad, there was so many scraches and body of set was broken two side. The condition of set also accepted by dealer that is very bad. Again returned to the dealer and dealer assured that set body would be changed and ractified the all problems. After 10-12 days I asked to dealer the dealer said that the mobile set has sent to service centre Sarkaghat. I went to there and saw that the mobile set was on a shopkeepar cabin draw and he opened the set and change there mike in another room and handed over to me. But when I traced out the list of lava authorised service centre then I came to know that ther is no service centre and set has no company seal and the dealer is not change my mobile set body and also the software of Lava B5 was not loaded that set, in that set Lava B2 software is loaded and same was shown to the dealer.
Now I requested to compay to change and mobile set immediatly, if the company not change my set within 15 days then I will proceed it in consumer court and I will not be responsible for all that

Answer : Dear Consumer,
I am happy that you are aware of your valuable consumer rights. Thanks for sharing your inputs and suggestions regarding the product and services which would be beneficial and guiding for the prospective consumers. You can very well take legal action by complaining in the district consumer forum. Any damage taken place in their service centre is their responsibility. They have to compensate for it. As far as legal action is concerned, send a legal notice containing all the relevant details and consumer complaints to the company and to the dealer from where you purchased the product. I hope they would be sensible enough to respond. Keep a record of the all the communications exchanged. Thereafter, if the response is not positive you can file consumer complaint with the district forum.
