Question : i have purchased a Nokia 6303i classic model handset from Cell 4 u, s-45,GCDA complaex ,at Marine drive ,Ernakulam. it worrked hardly for 2 months and got the coplaint of "no access to network". i submitted the handset for serviece(around jan/2011) via the shope that it bought. They goven it for service got it back from them saying that the phone in god condition. After one and half week the same complaint repeated again,send it back to the same shope. whenever i enuired about that they said that the phone is with service center last two months was said that the phon is under service i could not able to submit the phone personaly because it is so very dificult to reach from my aria (U.T. of Laksheedweep) and iwas comppeelled to rely on shape keeper. when i came at Ernakulam for the purpose an exam i enquired about my phone and he told that the cell is with him.I collect it from him and went back to Nokia service center fro ther i came to know that that stupid spopekeer hasn't given to any centre for service,wven the first complint lodged was not real as i said above.thThe cell is send back to the company again as earlier and told me to weight for another 15 days.
it is going to be six months, and used hmy set hardly for two and half month.so kindly provide a provisionto get the value for my money otherwise i will be forced to getit through consumer courte.

Answer : Dear Consumer,
As you have indicated, we are happy to know that you are aware of you consumer rights. This is prime example of harassment at the hand of the shopkeeper. The reseller has misrepresented by keeping your phone unnecessarily. Considering facts of your case, you should issue a legal demand notice to the shopkeeper of wrongfully keeping your phone. You can also write to the company for the deficiency in the services. If you are not satisfied with the reply, then you can move with consumer complaints in the consumer forum and ask for damages. You can also ask for the damages caused to you due to non availability of the phone. Keep a record of all your communication exchanged
