My Spice mobile is not working fine

Question : I have purchased Spice QT68 mobile from Spice Telecom Authorised Showroom Cellucom from Nirmal Life Style, Mulund, Mumbai for 4999/- IMEI NO91055020013274 & 7 Invoice No228162701 dated 09/01/2011. This mobile has manufacturing faults.
Shortcut keys navigate to different shortcuts.
Optical Keyborad stucks with USB connection.
Mobile get frequently restrted.
Webcam Function not working.
Charger non functional
I have called up Cust Care for the issue they accepted the fault & asked me to visit Taipan Service Center, Koparkhirane, Navi Mumbai.Service Job Sheet Work Order No: SMH2622112000111. I got my mobile 50% serviced. But for Webcam Service & Mobile Restarting problem persist. Service Center ask me contact service center again or contact seller for mobile replaced.
Surprisingly the Cellucom Shorrom is closed foever @ LS, Mulund. I have no where to go now.
I am sick of repeating same procedure.
I am thinking of raising Complaint in District Consumer Forum againt the Company for seling Faulty mobile in Authorised Service Center & later on running away from providing services.
I want mobile replaced with new mobile or money back from company. I have paid MRP for the mobile when its available @ less than 4000 in open market because I wanted a genuine product from Authorised Showroom. I feel cheated by Spice Telecom.

Answer : Dear Consumer,
It is very good that you are aware of your consumer rights. It seems that your product is under warranty, therefore, you can get it repaired free of cost. As stated by you in your consumer complaints this is a case where the product was having an inherent manufacturing problem. The quality maintained by the company is not good. There are deficiencies in the service on the part of the dealer and the company. You have to take a legal action to put them in motion. Do not feel cheated as you can very well take legal action by complaining in the district consumer forum. But before that in the first instance you serve them with a registered letter in shape a legal demand notice containing all your details and intimate them failing this you can file complaint with the district forum. Keep a record of the all the communication for the future reference. I am sure some sense will prevail over them and they will do something about your problems after receiving notice only.
