Question : I HAVE PURCHASED SPICE MOBILE 6868 FLO(IMEI NO. 911114150409289) ON 16/12/12 FROM NAGAUR RAJASTHAN BUT IT GOT FAULTY AND THE SAME WAS PLACED AT A.M. COMMUNICATION NAGPUR ,MAHARASHTRA ON 06/01/12 FOR REPAIRIG AND ASSURED TO PROVIDE THE MOBILE AFTER 20-25 DAYS ON REPAIRING BUT AFTER ELAPSE OF 35 DAYS MY MOBILE NOT YET REPAIRED/RETURNED BY THE ABOVE AGENT.

What can be more disturbing getting the product defective within such a short span of their purchase? This is nothing but sheer harassment of consumer at the hand of companies who make big claims for their products and have little reality when it comes to support their consumers. It seems to be a case of inherent manufacturing defect. Its company’s duty to repair it to your satisfaction and that is too without charges. Any such delay or dissatisfaction in repairing the product would amount to deficiency in services which is actionable under the consumer act as prevailed in India. You can write a letter to both the company and the seller and call upon them to rectify all the problems and return back the product within a specified time. Please keep a record of all the essential documents which would be crucial to establish your case in the consumer forum if replacement of the product is required.
